Judge Blocks Law Banning Dismemberment Abortion

On Thursday, Kansas District Court Judge Larry Hendricks blocked a Kansas law that that would have banned all dismemberment abortions, ruling that the law presented too big an obstacle for women looking to kill their children.

The law, which would have taken effect on July 1, was the first of its kind by banning an abortion procedure used in approximately 95 percent of all second-trimester abortions nationwide. Opponents to the law argued that it would force women to undergo riskier procedures. 

The Center for Reproductive Rights, which filed the lawsuit on behalf of Dr. Herbert Hodes and Dr. Traci Nauser – a father and daughter who perform abortions – argued that other methods of abortions such as "giving the fetus a lethal injection or by severing its umbilical cord" have the potential to cause increased "nausea, vomiting and infection in women." They also argued the law would lead to "forced experimentation" on women seeking second trimester abortions.

The state argued that it had an obligation to promote more "humane" abortion alternatives for the dignity of the child. The Center for Reproductive Rights countered their claims, effectively arguing that the ban would enable the Legislature "to assert the same interests and ban every single abortion method." Judge Hendricks agreed and even said the Kansas Constitution protects abortion rights as much as the U.S. Constitution, ruling to put the law on hold while he considers a lawsuit filed.

"The alternatives do not appear to be medically necessary or reasonable," Hendricks said from the bench Thursday.

Jessie Basgall, attorney for Kansans for Life, had hopes that the law would eventually prevail when the lawsuit goes to court.

"This is just whether or not the law is going to stand while we actually litigate the merits of this law," she said.

Kansas Planned Parenthood President and CEO Laura McQuade had different thoughts, promising that her organization along with others would see to it that "this ban is unable to harm even one Kansas woman."

Both Republican Gov. Sam Brownback and Attorney General Derek Schmidt expressed deep dismay over the ruling. AG Schmidt slammed Judge Hendricks ruling as being "based on an unprecedented interpretation of the Kansas Constitution."
