New York Governor Pushing Bill for 3rd-Term Abortions

New York Governor Andrew Cuomo is pushing a bill in the New York state legislature that pro-life advocates are aggressively opposing. They say the so-called Reproductive health bill is the “the most sweeping abortion legislation in the nation” because it would  lift limits on third-trimester abortions and allow non-physicians to do abortions.

“Gov. Cuomo’s bill elevates abortion to a fundamental right and says New York state can’t discriminate on abortion in benefits or services or anything else it provides,” said Kathleen Gallagher, the New York’s Catholic Conference director of pro-life activities.

Cuomo’s legislation, she said, would make illegal abortion restrictions, such as parental-notification laws, informed-consent laws, restrictions on taxpayer funding of abortion and abortion bans of any kind,” she said in an interview.

The Catholic Conference has a breakdown of what the extreme legislation would do, explaining that it  does not simply “update” New York law or codify Roe vs. Wade. It would usher in extreme and sweeping changes to abortion policy in New York State.

The bill would permit unlimited late-term abortion on demand. Current state law says abortions are legal in New York through 24 weeks of pregnancy (Article 125 Penal Law), but outlawed after that unless they are necessary to save a woman’s life.  This bill would repeal that law and insert a “health” exception, broadly interpreted by the courts to include age, economic, social and emotional factors. It is an exception that will allow more third-trimester abortions in New York State, a policy which the public strongly disapproves.  This ignores the state’s legitimate interest in protecting the lives of fully formed children in the womb, and ignores the will of a majority of New Yorkers who oppose late-term abortion.
The bill would endanger the lives of women by allowing non-physicians to perform abortions. While current law states that only a “duly licensed physician” may perform an abortion, this bill would allow any “licensed health care practitioner” to perform the procedure prior to viability. This dangerous and extreme change clearly puts women’s health at risk, and mirrors a national abortion strategy to permit non-doctors to perform abortions due to the declining number of physicians willing to do so.
The bill would preclude any future reasonable regulations of abortion. It would establish a “fundamental right of privacy” within New York State law, encompassing the right “to terminate a pregnancy,” even though the Supreme Court has rejected, numerous times, classifying abortion as a “fundamental right.”  Therefore, it is impossible to say that this legislation simply “codifies Roe vs. Wade” in New York law.  It goes well beyond Roe. The Court has said that states may regulate abortion, as long as those regulations do not place an “undue burden” on the right to an abortion. This bill says that abortion is fundamental and thus untouchable – no regulations on abortion, ever. No parental notification for minors’ abortions, no limits on taxpayer funding of abortion, no limits on late-term abortions, no informed consent for pregnant women seeking abortion. None of the commonsense regulations enacted by the vast majority of states and supported by large majorities of the public would be allowed in New York.
The bill endangers the religious liberty of Catholic hospitals and other institutions. While the bill contains limited conscience protection, that protection is ambiguous and inadequate and is extended only to individual health providers who do not wish to “provide” abortions (protection that is already guaranteed by Civil Rights law.) What is not provided in the bill are protections for institutional providers, such as religious hospitals and other agencies that do not wish to be involved with abortion. The bill declares that “the state shall not discriminate” against the exercise of the fundamental right to abortion in the “provision of benefits, facilities, services or information.”  In other words, it would permit state regulators, such as the State Health Department or State Insurance Department, to require support for abortion from any agency or institution licensed or funded by the state.
The bill could be used to undermine the state’s maternity programs.  In a similar way, these beneficial programs, which are working well to reduce infant mortality, could be ruled “discriminatory” for favoring childbirth over abortion, and be denied state benefits if this bill were to become law.
“The abortion expansion bill is uncompromising in its terms and extremely sweeping in scope.  The bill goes against the increasingly pro-life sentiment in this country, as evidenced by the most recent Marist poll (December 2012) which found that more than 8 in 10 Americans favor significant restrictions on abortion.  The Gallup Organization (May 2011) found that only 27% of Americans believe abortion should be legal under all circumstances. The majority of American adults (61%) believe abortion should either be more strictly limited than current law or not permitted at all,” it says.

The conference adds: “Not only does the bill defy public opinion, but it also defies common sense.  New York State remains the abortion capital of the nation with the highest abortion rate of any state. New York City’s abortion rate remains at 40%, with some geographic regions within the city at 60%.  The reality is that no woman is without ample opportunity for an abortion in New York State.  Rather than voting on a bill that will increase the tragedy of abortion, we urge policy makers to look at constructive ways to reduce abortion and truly make abortion “rare.”

Four Doctors: We’re Proud to Be Doing Third-Trimester Abortions

This is one of those stories where it helps to take a deep breath and remember that because of the lies surrounding abortion, many people simply don’t realize what they are defending. Abortion supporters think they are on a moral crusade, one which they would say is about defending women’s rights.

That being said, however, sometimes the gap between “good intentions” and actions is harder to understand. Such is the case when artists set out to tell “a more human” story about abortion, and end up leaving out crucial information that any journalist would naturally find important. This is pretty much the definition of propaganda.

The Los Angeles Times reports:

Premiering today at the Sundance Film Festival as part of the U.S. documentary competition, “After Tiller” is an intimate and heartfelt look at the four doctors performing third-trimester abortions in the United States, doing so even after the 2009 assassination of such a physician, Dr. George Tiller. … the film brings an emotional clarity to an issue in which every nuanced turn of phrase has been made politically complicated.

“Anyone who has proclaimed violence his method inexorably must choose lying as his principle,” is the way Alexander Solzhenitsyn – a man of some emotional clarity – referred to the “nuanced turn of phrase” to hide the slaughter of innocents. Yes, killing human beings en masse does result in, among other things, political complications.

The author of the Times article describes how the event’s organizers made sure that “visible security measures were in place, including police and armed sheriffs in green jumpsuits.” Because, as everyone knows, you can’t be too careful: one of those little old ladies with their rosaries might show up, and, well… things can get out of hand quickly. Or, given the framing of the entire story as being “After Tiller,” these measures could be part of the stagecraft of the film, as promoters are wont to do at Sundance and other such festivals.

“I feel like our generation has been really alienated from the abortion debate,” added Wilson. (Both filmmakers are 29.) “It’s just become a shouting match. We wanted to make something that would show the complexity and the gray area. The gray area over this issue is where real women are making real decisions about their lives.”

Actually, somewhere just below a third of Wilson’s generation has been permanently alienated from the abortion debate because they’re dead. They were killed in abortions. And is the debate back on now? Because the pro-abortion left keeps telling us that the debate over abortion, including the abortion of fully viable human beings, is over. If the debate is back on, this is a positive development: maybe we can get young filmmakers to make a documentary about last-trimester abortion, have them actually show the procedure, and start a conversation about whether this sort of thing should be legal.

Perhaps the filmmakers can take an “intimate and heartfelt look at” women who have had their third trimester child – translated “viable, living human being” – aborted. Maybe they can follow them through their next, wanted, pregnancy and capture their reaction to the ultrasound of their child at the point where their last one was aborted. Now that would be courageous storytelling.

Unfortunately, I don’t think these filmmakers consider this a relevant part of the conversation.

Even in the face of threats and the killing of [murdered late term abortionist George] Tiller, the doctors see their work as important and worth continuing. As to whether the protests against what he does ever gave him doubts regarding his work, Dr. LeRoy Carhart said, “I never even give it a second thought.”

Here again we see the “frame” alluded to in the title. Since these four doctors pursue their non-lifesaving work even “After [the murder of George] Tiller,” they must be courageous and selfless heroes. This framing is extremely offensive, and is not nearly as objective as the filmmakers and the writer of this article would have us believe.

Still, even in such bias there are insights to be gleaned. For Carhart, the protests don’t elicit a second thought. How about admonishments from the Maryland board of physicians? Or the horrifying ordeal and death of 19-year-old Christin Gilbert in 2005?

Human Life International is requesting a copy of the film, to see if these and several other narrative-complicating issues are treated in it. If they are not, then one is forced to conclude that this movie is not so much about “starting a conversation” (which is what EVERY SINGLE documentary filmmaker says is the goal of his or her project) as it is about covering over the fact that late term abortion is the violent destruction of a human beings – little babies who are often healthy and capable of living outside the womb.

Doctors do not avoid this particularly gruesome practice for fear of being killed, they avoid it because they have consciences and do not want to kill innocent, viable children. Yes, let’s have a conversation about late term abortion, but let’s look at the whole story.

With Highest Abortion Rate In Nation, Cuomo Seeks To Expand Abortion Further

Gov. Andrew Cuomo (D-NY) unveiled a bill on Tuesday that would radically expand abortion-on-demand in his state. Cuomo likened his 10-point plan, called the “Women’s Equality Act,” to a “bill of rights.”
 
The bill, which is aimed at strengthening women’s rights, includes a plank that would remove abortion from the state’s penal code and affirm abortion at any point during pregnancy if the mother’s health is in danger, a category that is so broad it could allow abortion at any time.

Referring to the bill as the “Back-Alley Abortionist Empowerment Act,” Charmaine Yoest of Americans United for Life (AUL) said that if the legislation passes, “New York will be sanctioning unrestricted, virtually unregulated, and taxpayer-funded abortion-on-demand, making it the most radically pro-abortion state in the nation.”
 
Currently New York, which has the nation’s highest abortion rate, allows abortions past 24 weeks to save the “life” of the mother, and only doctors may perform them.

The state’s Catholic bishops expressed concern, in a statement, that the legislation would be expanding late-term abortion and that it would be “opening the door for non-doctors to perform abortions.” In addition, the bishops added that they “find the conscience protections in the bill to be vague and insufficient,” and that they “are concerned about the religious liberty of our health facilities.”

Though Cardinal Timothy Dolan said that he is “profoundly distressed” by the governor’s bill, he supports the other nine non-abortion planks. However, he has asked the state’s Catholics to “fully oppose” the legislation as long as it contains the abortion expansion language.

The bill, which is supported by NARAL, drew strong criticism from New York’s GOP state Senate leadership.

Kelly Cummings, spokeswoman for GOP Senate Minority Leader Dean Skellos, referred to the abortion provisions in the bill as “a political maneuver designed to curry favor with the extremists who want to expand late-term abortion, and open the door to non-physicians performing abortions. It’s wrong for New York.”

Bill Donohue of the Catholic League said that Cuomo’s bill may negatively impact the governor’s apparent national political aspirations.

“Andrew Cuomo’s lust for abortion rights has effectively killed his chances of ever becoming president of the United States,” said Donohue. “Once he ventures outside the Empire State he will find out- the way his father Mario did- just how out of touch he is with public sentiment on this life and death issue.”

However, Dave Andrusko, writing for LifeSiteNews, states that Cuomo is rolling out his legislation because he “no doubt already believes that there is electoral gold to be mined by being the most pro-abortion Democratic presidential candidate in a field that will be awash with pro-abortion candidates.”

The theory is that New York is so “pro-choice” that if Cuomo markets the provision in the right verbiage, politicians will fall prostrate at his feet…
 
Or, as Cuomo has said, “There is a simplicity and a clarity to the ‘choice’ language,” adding, “You’re pro-choice or you’re not pro-choice.” That 70-80% of the American public draws lines in the sand that Cuomo gleefully would erase makes no difference to the son of former pro-abortion New York Gov. Mario Cuomo. In other words, there is a difference between being “pro-choice” in the abstract and accepting abortions long after unborn babies can feel pain or have reached viability.
 
Andrusko observes a statement by Kirsten Smith, spokeswoman for New Yorkers for Life, in the Daily Gazette. Smith said, “It is fitting that the Governor unveils his abortion expansion language today, on the day that Planned Parenthood has organized buses to come to Albany to support his agenda.”
 
Smith continued, “One need only follow the money to see that Planned Parenthood’s abortion industry would be the beneficiary of any expansion of late-term abortion in New York…New Yorkers do not benefit.”

Why is it it's always the CATHOLICS that are the "protagonists" in all of this? With that being said, let's not forget that RONALD REAGAN passed a big pro-abortion bill when he was governor of the great state of California in the late 60's - at the time, only a couple of other states legalized abortion. Pt being that by the time Roe V Wade was passed by the USSC a few years later, by then a handful of states had abortion legalized, which pretty much opened the door for RvW, largely thanks to Reagan opening the floodgates in the largest state in the union.

Depravity sowed doesn't reap overnight, but it doesn't go away either.
