Assisted Suicide Bill Introduced In New York

Death With Dignity Legislation Inspired by Brittany Maynard Introduced in Albany

Legislation seeking to give terminally ill New Yorkers the choice to end their life under a doctor’s care—modeled off an Oregon law that made headlines late last year when Brittany Maynard moved to the state to end her life—has been introduced into the State Senate in Albany.

“The option to end one’s suffering when facing the final stages of a terminal illness should be a basic human right, and not dependent upon one’s zip code,” State Senator Diane Savino said in a statement today. “With solid support for aid in dying across every demographic, I believe there will be strong bipartisan backing for this bill.”

The New York End-of-Life Options Act, introduced late last week by Ms. Savino and Mr. Hoylman, is modeled off the law in Oregon. It would allow adults to obtain a prescription from a physician for a lethal dose of medication that a patient can take on her own to end her life. The lawmakers told the Observer last month they had been inspired by Ms. Maynard’s story to make the options she moved to Oregon for available to their own constituents.

Aid in dying laws are on the books in just five states, including Oregon, where Maynard, 29, moved from California so she could end her life while suffering from the effects of a terminal brain tumor. With Compassion & Choices, an advocacy group that supports death with dignity legislation and is backing the push for the bill in New York, Ms. Maynard took her story public, releasing a video stating her intentions to end her life under the law.

“She really did touch a lot of people in a way that really got them thinking,” Maynard’s husband, Dan Diaz, told the Observer last month. “We don’t like to think about death, but because she put a face to it, because of her age, because of being so young and being well-spoken and speaking up, it did have an impact.”

Since his wife’s death, Mr. Diaz, has been speaking to the media—and lawmakers, including Ms. Savino—advocating for other states to adopt similar laws.

“It just boils down to, if you applied this to yourself, if you were unfortunately found to be in this position, would you want the option?” he asked in an interview with the Observer last month.

The New York legislation, like in other states where it’s already law, would require the patient to be terminally ill and mentally competent, two physicians to confirm the prognosis is terminal, two witnesses to attest the request is voluntary, and includes felony penalties for coercing or forging a request. The bill covers physicians against civil or criminal liability, and participation would be voluntary.

The legislation is sure to face some opposition, particularly from religious groups that have long opposed hat they’ve called assisted suicide. Cardinal Timothy Dolan told the Daily News he would oppose any such bill.

“The real death with dignity, the real heroes are those who die naturally, who take each day at a time, savoring everything they’ve got. That is death with dignity,” the Catholic leader told the News.

Mr. Diaz said it was backward for opponents to “impose their beliefs” on someone like his late wife.

“The idea that they would impose their wishes on her, insist that she suffers, that to me is ridiculous,” Mr. Diaz told the Observer.

A spokeswoman for Gov. Andrew Cuomo said his office would review the bill. The Senate is co-led by the Republicans and the Independent Democratic Conference, of which Ms. Savino is a member—though the GOP has more power now that it could have its own majority. Republican Senate Leader Dean Skelos’ office did not immediately respond to a request for comment about his position on the bill. Similar legislation has been introduced into the Assembly by Assemblywoman Linda Rosenthal.

Compassion & Choices said it would be looking to Ms. Savino’s clout as a member of the Independent Democratic Caucus to help move the legislation forward in the Senate.

“As a key member of the Independent Democratic Caucus in the New York State Senate, Senator Savino is well positioned to gain bipartisan support for New York’s aid in dying bill,” Barbara Coombs Lee, president of Compassion & Choices, said in a statement.

Is Involuntary Euthanasia in Our Future?

 Laura is a 24-year-old in Belgium who plans to die by euthanasia this summer.  She is not terminally ill.  Rather, she explains that she has wanted to die ever since she was a child.  "Life, that's not for me," she says.  She has been approved for death by lethal injection.  The chairman of Belgium's federal euthanasia commission recently stated that 50 to 60 psychiatric patients like Laura are euthanized each year.
 
Belgium legalized euthanasia in 2002.  Last year it became the first nation to legalize child euthanasia.  According to The New England Journal of Medicine, Belgian doctors also "hasten the death" of patients "without an explicit request."  More than 1,000 patients a year are euthanized in this way.  As Cambridge professor Jack Keown explains, "If a doctor thinks death would benefit the patient, why should the doctor deny the patient that benefit merely because the patient is incapable of asking for it?"
 
More countries are asking similar questions.  In a recent poll, a majority of people in 13 out of 15 nations agreed that euthanasia should be legal.  Some 20 states in America are considering euthanasia measures.  According to Gallup, 69 percent of Americans believe physicians should be able to legally "end [a] patient's life by some painless means."  This is nearly double the percentage who supported euthanasia in 1950.
 
As we deal with this difficult subject, what biblical facts should we consider?  (For more on this issue, see my "Euthanasia and the Word of God.")
 
One: human life is sacred.  We are made in God's image (Genesis 1:28; 9:6; 1 Corinthians 11:7; James 3:9).  So long as people are able (or potentially able) to relate to God, their environment, others and themselves, they retain God's "image."
 
Two: we should not choose medical options intended to cause or hasten death, since God gives us life (Job 33:4), numbers our days (Job 14:5), and appoints our time to die (Hebrews 9:27).
 
Three: we are not obligated to extend biological life when the "image" of God is no longer present.  Removing a person from life support does not prevent God from acting miraculously—he raised Lazarus from the grave after he had been dead four days (John 11:38-44).  Our Father does not require medical support to heal.
 
One more point: I believe we can choose medical treatments that enhance our quality of life, even if these treatments have the unintended consequence of shortening life.  "Palliative care," medical attention that intends to relieve symptoms and improve life quality for the patient and family, can be extremely valuable.
 
Expect to see more countries go the way of Belgium.  A culture that views truth as subjective opinion has no objective reason to value human life.  But God does.  He made each of us in our mother's womb (Psalm 139:13-16) and engraved us on the palms of his hands (Isaiah 49:16).
 
And since we're all dying, he invites us to say with Paul, "We do not lose heart.  Though our outer self is wasting away, our inner self is being renewed day by day."

New York Lawmakers Propose Assisted Suicide Bill

awmakers in New York have proposed a bill that would allow terminally ill patients to request from their doctors a lethal prescription to hasten their death.

The Medical Aid in Dying Act was introduced during a press conference on May 10 in the state’s capital. It is sponsored by Democratic Rep. Amy Paulin and is based on Oregon’s “Death With Dignity Act,” under which Brittany Maynard ended her life in 2014.

“If I am terminally ill, I should be able to choose to end my life calmly, peacefully and in a dignified way, at a time and in a setting I choose where I am surrounded by those I love,” Paulin said in a statement. “That is what my bill is about.”

“A patient may make a written request for and consent to self-administer medication for the purpose of ending his or her life in accordance with this article if the patient: (a) has been determined by the attending physician to have a terminal illness and which has been medically confirmed by a consulting physician; and (b) voluntarily expresses the request for medication,” the bill, A10059, reads.

Those who spoke in favor of the proposal included Dr. Bill Levering of the First Reformed Church of Schenectady.

“I’m pleased to be able to be here today to represent the perspective of clergy who work with folks who are facing pain and fear in relation to their death,” he said. “We care about their dignity. We care about the holiness of their life. We care about preserving the thing that makes us human: our ability to decide about our lives.”

“We select our careers, our hometowns, and our places of worship. We make decisions about our way of life every day. Until the end. Then, someone else gets to decide? This is not the way of a caring people,” Levering asserted.

But others have expressed concern, stating that death is not the proper response to suffering.

“Physician-assisted suicide represents a complete abdication of our moral responsibility to persons who are suffering from terminal illnesses. Rather than caring for such persons with the utmost sensitivity and compassion, the sponsors of these bills would have us simply expedite their demise. The State of New York must do better,” said the organization New Yorkers for Constitutional Freedoms in an email released on Sunday.

Members of the group Not Dead Yet in Rochester attended the press conference in bright pink shirts and holding signs such as “World’s cheapest health care,” featuring a graphic representative of a bottle of lethal pills. Not Dead Yet sent a letter to lawmakers on Friday explaining why it opposes the measure.

“Among the top five reasons given [for assisted suicide] are feelings of being a ‘burden on others’ (41%) or feeling a ‘loss of autonomy’ (92%) or ‘loss of dignity’ (78%). These are not about pain from a terminal disease, but are psychological and social issues that cry out for meaningful supports and genuine care,” the correspondence reads, authored by President Diane Coleman.

“Yet the assisted suicide law does not even require disclosures about consumer controlled home care options to address feelings of loss of autonomy or feelings of being a burden on family, much less require that those services be provided,” she said.

Others have also noted that  “nder the law, doctors who ‘aid-in-dying’ are required to state untruthfully on the death certificate that their patient’s cause of death was their underlying illness, and not the lethal dose of drugs they prescribed that killed them.”

A vote is expected on the matter in the Assembly Health Committee on Monday.
