Same thing happened 8 years ago when someone asked John McCain (then Prez GOP candidate) over Obama's Muslim ties - he vehemently denied it. (and we know the rest of the story 8 years following) McCain ended up calling Obama a good man!

Bad news for Ted Cruz: his eligibility for president is going to court

The Circuit Court of Cook County in Chicago has agreed to hear a lawsuit on Sen. Ted Cruz's eligibility for president — virtually ensuring that the issue dominates the news in the runup to the South Carolina primary.

Cruz was born in Canada to a US citizen mother and a noncitizen father. The Constitution requires presidents be "natural-born citizens," but what exactly that requires hasn't been settled in court.

Now, perhaps, it will be. The lawsuit in Illinois aims to resolve the question by challenging Cruz's eligibility for the presidency. It was filed by Lawrence Joyce, an attorney who has told local media that he supports Dr. Ben Carson and has had no connection with the Trump campaign.

"Joyce said his concern is that the eligibility issue lie unresolved during Republican primaries, thus letting the Democrats take advantage of it after a potential Cruz nomination, when it’d be too late," reports the Washington Examiner.

When this question initially came up, the conventional wisdom among constitutional lawyers was that it was a nonissue: Cruz was obviously eligible. But as the debate has heated up among candidates (with Donald Trump, in particular, fanning the flames), it's also begun to heat up among constitutional law scholars.

The issue is actually twofold: whether Ted Cruz should be considered a natural-born citizen, and whether Cruz's own preferred school of constitutional interpretation would see it that way.

The problem: the meaning of "natural-born citizen"

Here is what the Constitution says about who can be president:

No Person except a natural born Citizen, or a Citizen of the United States, at the time of the Adoption of this Constitution, shall be eligible to the Office of President; neither shall any person be eligible to that Office who shall not have attained to the Age of thirty five Years, and been fourteen Years a Resident within the United States.

The problem is the Constitution doesn't define "natural born Citizen." Neither does any current law. And no one has ever brought a court case to decisively settle the question as a matter of US law.

There are three ways someone can be a US citizen. He can be born in the US (regardless of who his parents are). He can be born outside the US to at least one US citizen parent, as long as certain criteria are met. (Those criteria are set by federal law and have been changed over time.) Or he can immigrate here and then successfully apply for citizenship, a process called naturalization.

Everyone agrees that the first category of people are natural-born citizens. Everyone agrees that the third category of people are not natural-born citizens (regardless of how unfair it might be that immigrants can't be president). But Ted Cruz is in the middle category, and this is where the meaning of "natural born" starts to get fuzzy.

The only definition of "natural born" in US history would include Ted Cruz

Legal scholar and Ted Cruz tormentor Laurence Tribe.

Because there's never been a court case to explicitly test the question of who counts as a natural-born citizen for the purpose of presidential eligibility, the question is by definition "unsettled." It hasn't been resolved yet. And court opinions that have mentioned the term in passing while ruling on other questions have come to very different opinions about what it means.

But it's a stretch to say, as Harvard law professor Laurence Tribe did, that the scholarship on the question is "completely unsettled." That implies that scholars are totally split on the issue, which isn't exactly the case.

The majority of constitutional law scholars who've written about the meaning of "natural-born citizen" have agreed that if a court were to rule on the question, it ought to rule that someone born outside the US but eligible for citizenship through parents counts as "natural born."

One of the key arguments in favor of this point is that while there is no longer any law defining "natural born," there used to be one — way back in 1790. The Naturalization Act of 1790 explicitly said that "the children of citizens of the United States, that may be born beyond sea, or out of the limits of the United States, shall be considered as natural-born citizens."

That term disappeared from immigration law after 1795. While there's at least one scholar who argues that this was intentional, because Congress didn't want that definition to persist, there's no evidence for that. And since Congress didn't come up with an alternate definition, that remains, to this day, the only definition of "natural born" we have.

This isn't a smoking gun. Scholars have looked at English precedents, US judicial decisions, bills, and congressional debates to figure out what the meaning of "natural born" is supposed to be and how (if at all) it's changed over time. But while some scholars have maintained that the evidence supports a narrow meaning of "natural born" — one that wouldn't include Ted Cruz — more of them agree that the evidence supports a broader one.

What would legal scholar Ted Cruz say about the eligibility of candidate Ted Cruz?

One of the constitutional scholars who used to think that the definition of "natural born" ought to include Ted Cruz is Laurence Tribe, who was Cruz's law professor at Harvard. But Tribe is now the leading scholar raising questions about Cruz's eligibility. Trump has taken to citing Tribe approvingly in rallies; Cruz has fired back that Tribe is a liberal professor who is only interested in taking him down.

Why is Tribe raising questions about Cruz's eligibility, even if Tribe thinks Cruz should ultimately be eligible? There are two answers.

The first answer is that Tribe is making a claim about what Ted Cruz ought to believe the Constitution says.

Cruz is a proud supporter of the conservative legal tradition of constitutional originalism: interpreting the Constitution not by what its words ought to mean today, but by what the Founding Fathers meant as they wrote them in 1787. Cruz is arguably the national politician most closely identified with originalism; he's certainly the presidential candidate with the closest ties to the conservative legal movement.

According to Tribe, constitutional originalism defines "natural born" very narrowly, in a way that would exclude Cruz. By extension, Tribe argued in the Boston Globe, any judges Cruz would appoint to the federal bench as president would invalidate his own presidency.

But Tribe clearly doesn't believe this line of argument himself because he is very much not an originalist. And one of the points of his column is that maybe if originalism is such an inflexible theory that it wouldn't allow one of its own biggest supporters to be president, it is generally a bad idea. He points out that the reason the Founding Fathers didn't want immigrants to be president is totally moot today — but so is the idea of a "well-ordered militia." And if originalists like Cruz still support the Second Amendment, Tribe says, they can't wave away the "natural-born citizen" clause.

Originalists disagree about what originalism is and what it says about "natural born"

While you wouldn't know it from Tribe's piece, there is no one originalist take on what "natural-born citizen" means. The strongest supporters of a narrow definition that would exclude Cruz are generally originalists, but there's a more even split among originalists than there is among constitutional scholars as a whole.

Since the Founding Fathers never actually debated the meaning of "natural-born citizen" when writing the Constitution, originalist scholars have had to turn to other sources to figure out what the common understanding of the phrase would have been at that time. And the answers scholars come to differ depending on which sources they consult.

Some originalists, like Michael Ramsey of the University of San Diego — who fortuitously just finished a paper on this question when the topic came up in the campaign — argue that the Founding Fathers would have understood "natural-born citizen" to mean the same thing "natural-born subject" did in English law at the time.

Over the century before the Revolution, Parliament had passed several bills clarifying that children born abroad to British subjects counted as "natural-born subjects" (this mattered for inheritance reasons). So by the time the Founding Fathers were writing down the Constitution, the broad definition of the term was fairly well established.

Other originalists, like Mary Brigid McManamon of Widener University's Delaware Law School — who recently published a column in the Washington Post arguing that Cruz is ineligible to be president — think that laws passed by Parliament don't count.

To McManamon, the precedent the Founding Fathers used wasn't British law as of 1787, but the English common law tradition (law made by courts rather than legislation). And in the common law, "natural born" did not apply to children born outside the bounds of the country. That's why Parliament had to pass bills to include such children.

Each of these arguments is far more complicated, of course. (For one thing, some scholars argue that the common law wasn't as uniformly narrow as McManamon says it was.) But the debate among originalists as to what "natural born" means is really a debate among originalists as to what originalism ought to include. Should it include both common law and legislation, or just common law? Does a law passed in 1790 reflect the intent of the Founding Fathers, since so many of them were in Congress when it passed, or does it show that they needed to add something they thought wasn't in the Constitution already?

The truth is that there isn't nearly as much of a gulf between originalism and "living constitutionalism" as there might seem to be. Originalists look to a number of sources to figure out what the Constitution means, just like anyone else does. And even the living constitutionalists who've written about natural-born citizenship care about what the Founding Fathers meant it to mean at the time — that's just not the be-all and end-all of their jurisprudence.

This can only be settled in court. But who would nominate a walking court case?

Ultimately, this is, quite literally, an academic debate. As long as no US court has issued a ruling on the question, it wouldn't matter if every legal scholar in America agreed on the hypothetical meaning of "natural born." It would still be legally unsettled.

Congress could at least stick some kind of bandage on the question by passing a "sense of the Congress" resolution — that's what it did in 2008 to affirm the eligibility of John McCain, who landed in the "natural born" gray zone for different reasons from Cruz. But the Senate has made it clear that it intends to do no such thing for Ted Cruz. This probably is less because they don't think Cruz is natural-born than because Senate Republicans really don't like Ted Cruz, but it's a problem for him nonetheless.

That's the other answer to why Tribe is agitating against Ted Cruz. He doesn't believe any court in the country would actually rule that Cruz was ineligible (though, he claims, that's only because Cruz-style originalism isn't the norm). But, he writes, "it’s worth thinking about the legal cloud" hovering over Cruz in the meantime.

The problem for Ted Cruz here isn't so much that a court is likely to rule against him as it is that Republicans might be afraid to support Cruz for the nomination because they're worried his eligibility will become an issue. A court taking up the issue days before the South Carolina primary is pretty much his worst nightmare.

Donald Trump tones down fight with Pope Francis

(CNN)Nobody wants to tangle with the Pope -- not even Donald Trump.

One of the more unlikely battles to ever jolt a presidential campaign emerged Thursday when Pope Francis said Trump is "not Christian" if he wants to build a wall along the U.S.-Mexico border. Trump, true to form, shot back that the pontiff's comments were "disgraceful."

But by Thursday evening, the GOP front-runner was doing something unusual: de-escalating a fight.

"I don't like fighting with the Pope," Trump said at a GOP town hall in South Carolina hosted by CNN. "I like his personality; I like what he represents."

Trump called the Pope a "wonderful guy" and blamed the day's drama on the press.


"I don't think this is a fight," Trump said. "I think he said something much softer than was originally reported by the media."

Trump added he would meet with the Pope "anytime he wants."

For someone who has built a powerhouse campaign around confrontations with everyone from Fox News' Megyn Kelly to GOP opponent Jeb Bush, Trump's change in tone was striking. So what accounts for the shift?

The obvious answer is that he doesn't want to alienate Catholic voters, who comprise about 20% of the American electorate and likely don't want to see politicians pontificating about their Pope. Catholics consider the Pope not only the vicar of Christ, but also the successor to St. Peter, who legendarily holds the keys to the Pearly Gates.

But, like most Popes throughout history, Francis is also a political leader.

He heads a sovereign state -- Vatican City -- and meets regularly with world powers. When the Pope made his comments about Trump's stance on illegal immigration, Francis was returning from Mexico, where he met with government leaders, including President Enrique Pena Nieto.

And the Roman Catholic Church, most especially through its bishops, takes policy positions on a wide range of issues, from abortion to combatting the Zika virus.

In that sense, the Pope's remarks on Trump's proposal to deport undocumented immigrants and build a big wall between the United States and Mexico weren't terribly surprising.

Trump's rivals at the town hall largely stayed away from the brouhaha.

When asked about the controversy at the town hall, Ohio Gov. John Kasich simply said he was "pro-Pope."

"This man has brought more sense of hope and more about the do's in life than the don'ts," Kasich said, referring to the Pope. "This guy has been so humble."

Bush, who is a devout Catholic, didn't criticize the Pope's comments. But he said he personally wouldn't "question people's Christianity."

"I think that's a relationship they have with their Lord and savior and themselves. So I just don't think it's appropriate to question Donald Trump's faith," Bush said at the town hall. "He knows what his faith is."

An Illinois judge set a March 1 court date to hear arguments on the Ted Cruz eligibility lawsuit.

Cruz was born in Canada and held Canadian citizenship until June 2014. He is running for president of the United States.

An attorney for the Ted Cruz campaign asked a Cook County judge Friday to dismiss an Illinois man’s lawsuit challenging the Texas senator’s eligibility to run for president, citing that the Republican hopeful wasn’t properly served with the complaint.

Lawrence Joyce, an Illinois voter and Ben Carson supporter, brought his complaint earlier this month to the Illinois State Board of Elections, which dismissed it.

Now, he is appealing the case with the Cook County Circuit Court in Chicago, asking it to rule Cruz ineligible to run in next month’s GOP primary in Illinois. Joyce challenges whether the senator from Texas meets the criteria to serve as president because he was born in Canada.

Sharee Langenstein, an attorney for Cruz, said in court Friday it is “very, very clear” the Cook County court doesn’t have jurisdiction to hear the case because state law stipulates the candidate be served with the complaint. Joyce, a pharmacist and attorney from Poplar Grove, Ill., failed to serve Cruz, whose home address is listed in his petition to be placed on the state’s ballot, Langenstein said.

Judge Maureen Ward Kirby set a March 1 court date to hear arguments on the motion to dismiss. Joyce, who works the midnight shift at a hospital pharmacy, told the judge he wasn’t available for arguments before then because of work commitments. The Illinois primary is March 15 and early voting has already begun.

Despite the close timing, Joyce said it is worth letting his complaint play out.

“The nomination doesn’t take place until July,” Joyce said. “So if a determination is made after the primary that Ted Cruz is not eligible to be president then certainly it would be incumbent upon the Republican National Committee not allow the name of Ted Cruz to be entered at the convention in July.”

Voters in Texas and New York also have filed legal challenges on whether Cruz meets the citizenship qualifications. The Indiana Board of Election is scheduled to hear a complaint Friday from a Republican voter challenging whether Cruz and fellow GOP presidential hopeful Marco Rubio meet the “natural-born” requirement. Rubio, whose parents immigrated from Cuba, was born in Florida.

Two New York voters sued to boot Ted Cruz from the state ballots over questions about his citizenship.

Not that I'm defending Obama, but the big hypocrisy of these "Republican" voters is that the same ones that were screaming on towers to get Obama's fake birth certificate exposed, are also the same ones who have been trumpeting Cruz to be their "Reaganist Savior" for the last 3-4 years.

And for that matter too - where is Joe "America's Toughest Sheriff" Arpio(sp) on Ted Cruz? Remember his big "birther movement" against Obama 5-6 years ago? Where is Jerome Corsi? Who acted like he was doing all kinds of Columbo-like detective work to expose Obama. Yeah, Silence...SILENCE from these hypocrites!

As for Cruz - his wife worked for Goldman Sachs, had ties to the CFR, and Cruz himself is just a Jr. Senator (without much political experience to begin with) - but somehow he rose to the top of the food chain shortly after he got elected over 3 years ago. I think this picture paints much more than 1000 words.

I used to live in New Orleans - Louisiana is largely Catholic (which is why they call their counties parishes instead, only state to do so). Even Baptist ministers down there look and act very Catholic.(you couldn't tell the difference, really)

Which is why this guy in this video is probably Catholic - he may not be working directly with the Jesuits, but nonetheless at bare minimum he is greatly deceived, and thinks he is doing God's service.

And yes, Alex Jones is a Catholic too. And some of these New World Order "patriots" like Fritz Springmeier have praised Catholic leaders.

Louisiana has always, as long as it's been a state, been quite in tuned with it's French roots. It being a Catholic state should come as no surprise

Just want to say, Cruz and Obama have a lot in common. Both are foreign born and are not US citizens.

How do you figure? Just because he was born in Canada? His mother was American. According to the law, for persons born abroad between December 24, 1952 and November 14, 1986, a person is a U.S. citizen if all of the following are true:

-The person's parents were married at the time of birth
-One of the person's parents was a U.S. citizen when the person was born
-The citizen parent lived at least ten years in the United States before the child's birth
-A minimum of 5 of these 10 years in the United States were after the citizen parent's 14th birthday

Ted Cruz qualifies. Whether you like him or not is another matter, but he is eligible to run for President of the United States.

I'm not trying to be confrontational, but having a parent who was a military service member was not a requirement for American citizens born abroad. And that, brother Mark, is the disconnect.

We don't just get to ignore laws we don't agree with. Isn't that what Obama does on a regular basis? Ignore laws he disagrees with? I don't agree with the law that says abortion is legal. It doesn't change what the law is. A lot of people disagree with the law that marijuana is illegal. It doesn't change what the law is. We either have laws or we don't. If the people of the United States want a law changed, we have legal processes in place to change them.

Ted Cruz, according to US law, is a natural born citizen eligible to run for President.

New York Times columnist Ross Douthat caused outrage after he joked about how an assassination attempt could end Donald Trump’s presidential campaign.

“Good news guys I’ve figured out how the Trump campaign ends,” Douthat tweeted last night.



The tweet links to a video clip from the 1983 movie The Dead Zone, which features a character played by Christopher Walken attempting to gun down a political figure played by Martin Sheen.

In the plot, Walken’s character tries to kill the US Senatorial candidate (played by Sheen) because he has visions of him becoming president in the future and starting a nuclear war.

Sheen’s character holds up a baby as a human shield during the assassination attempt, destroying his credibility.



While joking about an assassination attempt on any public figure is crass, it’s particularly relevant with Trump because he faces a very real threat of being targeted.

As we previously highlighted, according to his former advisor Roger Stone, Trump now wears a bullet proof vest at all public appearance due to the sheer volume of death threats he receives on a regular basis.

Trump first began wearing the vest in October last year after after reports that the world’s most wanted drug lord El Chapo had put a $100 million bounty on his head. He also received Secret Service protection at around this time.

Following his controversial comments on Muslim immigration back in December, Twitter exploded with death threats aimed at Trump.

Reaction to Douthat’s Twitter quip from Trump supporters was forceful.

Douthat bills himself as a conservative, but in his latest column for the New York Times he concludes that “President Hillary” would be a better choice for America than “our own nuclear-armed Berlusconi”. 

Attacks on Trump from conservatives and members of the Republican establishment have picked up in recent days, with Mitt Romney remarking yesterday that the billionaire’s tax documents could be hiding a “bombshell” revelation.

Ted Cruz eligibility lawsuits have been filed in Texas, New York, Illinois, Alabama and now Pennsylvania.

Ted Cruz is a natural born Canadian citizen. He was born in Canada and did not renounce his Canadian citizenship until after he was a member of the US Senate in 2014.

The Cruz campaign wants to delay a Texas eligibility lawsuit against the Canadian born senator.

Last week a Republican lawyer filed a lawsuit against Cruz’s eligibility in Pennsylvania.

We’ve all heard the claim from Donald Trump that Sen. Ted Cruz, who was born in Canada, is not a “natural born citizen.”

If Trump’s right, Sen. Cruz isn’t eligible to be president. Now, KDKA has learned that the first test of that could happen here in Pennsylvania.

Last week, Sen. Cruz filed nominating petitions to run for president in Pennsylvania’s April 26 Republican primary. Now a Republican attorney from suburban Philadelphia has challenged Sen. Cruz’s right to run because he is not a natural born citizen.

“It is my contention supported by a number of constitutional scholars that it means one must be born in the United States, that the framers of the Constitution were very concerned about the influence of foreign powers over the nascent republic,” said attorney David Farrell.

In a petition filed with the state’s Commonwealth Court, Farrell, of Lansdowne, Pennsylvania, says Sen. Cruz’s Canadian birth certificate proves he was born in Canada, and the fact that his mother is an American citizen does not make him natural born.

“We’re going to get right to that constitutional provision to see if he is or is not eligible to be president,” Farrell said.

The Commonwealth Court hearing on whether to disqualify Sen. Cruz’s nominating petitions is now set for March 10.

Yah, because he was such a great candidate to begin with...  Roll Eyes This election really shows how the 2 party system works, they work together.

Is Mitt Romney about to enter the race for the Republican nomination?  As I have written about repeatedly, the Republican establishment is absolutely desperate to keep Donald Trump out of the White House.  If it comes to it, they will move heaven and earth to make sure that he is defeated – even if that means Hillary Clinton wins the election.  Right now, Trump has won three of the first four contests on the schedule, and he is projected to win almost every state on Super Tuesday.  This would put him on a clear path toward winning the nomination, and so establishment insiders are in full-blown panic mode.  At this point, two different plans are being put forward for how to proceed if Trump continues to roll.  One is to have Marco Rubio exit the race so that Mitt Romney can run against Trump, and the other is to run a third party candidate against Trump and Clinton in the fall.
