College Park couple says front yard vegetable garden is under fire again
Helvenstons launch protest of Orlando's law after facing fines


 A College Park couple's vegetable garden is on the chopping block again after the city threatened fines if they don't uproot it by Thursday, according to the Institute for Justice Florida Chapter.

Jason and Jennifer Helvenston are launching "Plant a Seed, Change the Law," a protest of Orlando’s law, which they say violates their constitutional right to peacefully use their property to grow their own food.

In November, Local 6 broke the story about the controversial garden after the city told the Helvenstons their 25-by-25-foot front yard vegetable garden was not in compliance with the city's code.

After hundreds of emails supporting the couple flowed in and initially allowing the Helvenstons to keep their garden, saying it will hold off on violations, the city has since asked the couple to uproot the garden and replace it with a lawn or face fines.

"The greatest freedom you can give someone is the freedom to know they will not go hungry,” said Jason Helvenston. "Our Patriot Garden pays for all of its costs in healthy food and lifestyle while having the lowest possible carbon footprint. It supplies valuable food while being attractive. I really do not understand why there is even a discussion. They will take our house before they take our Patriot Garden."

According to Ari Bargil, an attorney for the Institute for Justice, the Helvenstons have a scheduled inspection and will be fined starting on Thursday, up to $500 a day.

"We are seriously interested in taking a look at this," Bargil said, when asked if the firm would be suing the city of Orlando. "We're focused on helping the Helvenstons get the word out, encouraging the city to reach a sensible compromise here."

Local 6 has reached out to the city of Orlando for comment, but has not received a response.

"We are asking residents across Orlando and the country to join us in planting a ‘Patriot Garden’ in their own front yards,” said Jennifer Helvenston.  “Please email us at patriotgarden@gmail.com and we will send you a free packet of radish seeds and a small sign for your front yard that says ‘Patriot Garden:  Plant a Seed, Change the Law.’"

Stuff like that blows my mind. I'm amazed that people actually think like that city council. I mean what do they hope to gain from such nonsense? Are they really that vain in claiming they don't want their neighborhood's values to decrease because of a "farm" down the street?

It must be part of the effort overall to literally uproot families so they can't fend for themselves, and instead make them dependent on the system, which makes sense considering what they ultimately have planned for the masses.

i dont get how they can force this on private property, it seems that the council is conditioning the Helvenstons and citizens that the council are the bosses and can tell the citizen's something and they must acknowledge the council's decision or get fined. What happened to love thy neighbour?

There is no love in the secular world.

Basically, they do this by defining land for residences, agriculture, industrial, etc. through "zoning laws". If your land is zoned residential, you can't have agricultural stuff going on, so says the laws. This keeps chicken and cows out of the neighborhoods, so as to not "bring down property values". It's all vanity reasons, on the surface. Ultimately, it's about control over a population.

You're not allowed to have container gardens on balconeys at my apartment. Of course this isn't in the lease, but is so the "community looks beautiful to everyone" or so they say. It doesn't stop me from gardening.

They say you can't have "container gardens", yet that rule is not in your lease? Uh, that is not legal. If your in the US, a landlord cannot have rules that are not part of the lease agreement. If they say you can't do it, that must be stated in the lease terms. Period.

Also, they can't make up rules and apply them selectively on residents. This is why the terms must be in the lease that ALL residents are to abide by. The reason is to stop thug landlords from being biased against certain residents and not others. One rule for all, not certain rules for certain residents.

Whatever an apartment community says you can or can't do, it MUST be spelled out in your lease. And if they make any changes to those terms, it must be for all residents, not select ones, and all residents must be notified of the change with a certain grace period before the new rule takes affect.

And remember, if the landlord is breaking their own lease, or doing things that violate the "Landlord and Tenant Act", then they potentially void that lease, and the resident could be free to move without penalty, as well as be entitled to damages from the landlord.

They have these laws in place to try to put the clamps on thug landlords like the one you seem to have.

And I didn't know that. That is good to know.

Right now we are actually trying to move. We just can't find a cheap enough piece of land to buy in NE Ohio. We don't want a mortgage.

Any ideas for 5 acres 20k and under?

Not in that area. I'm out west.

5 for 20k shouldn't be too hard to find, but you may need to expand your search area. At 4k per acre, that's nearly subdivision price. Unimproved land is cheapest the furthest from towns.

Shocked that is pretty cheap in the US, you should see the prices for that here.
