Massachusetts Education Policy Mandates Allowing Boys in Girls’ Restrooms

The Massachusetts Commissioner of Education has released an outline of its new school policy regarding gender equality, mandating that boys be allowed to use girls restrooms and locker rooms — and vice versa — if they contend that they prefer to identify with the opposite gender.

The 11-page document, written by Mitchell Chester, is stated to be in response to a gender identity law that was passed last July in the state.

“This guidance is intended to help school and district administrators take steps to create a culture in which transgender and gender nonconforming students feel safe, supported, and fully included, and to meet each school’s obligation to provide equal educational opportunities for all students, in compliance with G.L. c. 76, §5 and the state regulations,” it states.

As part of the outline, entitled Nondiscrimination on the Basis of Gender Identity, Chester explains that students need to be permitted to use whichever bathroom or locker room they wish. He states that as long as the child asserts that they would rather identify with the  opposite gender, they should have the access that they desire.

“The responsibility for determining a student’s gender identity rests with the student,” Chester states. “A school should accept a student’s assertion of his or her gender identity when there is … ‘evidence that the gender-related identity is sincerely held as part of a person’s core identity.’”

He says that although some children may not like those of the opposite gender sharing such private and personal spaces, school officials must teach children how to overcome their feelings.

“Some students may feel uncomfortable with a transgender student using the same sex-segregated restroom, locker room or changing facility. This discomfort is not a reason to deny access to the transgender student,” the document continues. “School administrators and counseling staff should work with students to address the discomfort and to foster understanding of gender identity, to create a school culture that respects and values all students.”

He recommended that schools have a unisex bathroom available as well so that students are presented with various options to suit their comfort.

Chester also goes on to mandate that children be addressed by their preferred gender identity and not as their birth gender, including in official school documents, and that they be referred to by their new feminine or masculine name.

“In sum, school personnel should use the student’s chosen name and pronouns appropriate to a student’s gender identity, regardless of the student’s assigned birth sex,” he states. “For those students who have been attending a school and undergo gender transition while attending the same school, it is important to develop a plan for initiating use of the chosen name and pronouns consistent with the student’s gender identity.”

WND reports that some local organizations are disturbed about the policy.

“The School Commissioner’s first duty is to protect all students, from kindergarten to grade 12, not endanger them,” remarked Kris Mineau of the Massachusetts Family Institute. “The overriding issue with this new policy is that opening girls’ bathrooms to boys is an invasion of privacy and a threat to all students’ safety.”

Democratic state Representative Colleen Garry says that she is working on an amendment to the law that would close up any loopholes allowing such situations.

“Like many of my colleagues, I am very concerned about Commissioner Chester’s directive to open public school bathrooms to all genders,” she stated. “This was not the intent of the leglislature, and we need to pass legislation that clearly defines the use of such facilities.”

I expect no less from the world, as vile as it is. Any parent that claims to be Christian that still has their child in a public school needs to repent and get their child out of those dens of wickedness.

i agree with you kilika. and yeah i find it extremely disgusting  as well bornagain. most will not repent though sadly.  all kids should be homeschooled. or schooled by other christians. note replying froom phone and must keep responses short or will kick me off.

Students Who Refuse to Affirm Transgender Classmates Face Punishment

Parents across Massachusetts are upset over new rules that would not only allow transgender students to use their restrooms of their choice – but would also punish students who refuse to affirm or support their transgender classmates.
 
Last week the Massachusetts Department of Education issued directives for handling transgender students – including allowing them to use the bathrooms of their choice or to play on sports teams that correspond to the gender with which they identify.
 
The 11-page directive also urged schools to eliminate gender-based clothing and gender-based activities – like having boys and girls line up separately to leave the classroom.
 
Schools will now be required to accept a student’s gender identity on face value.
 
“A student who says she is a girl and wishes to be regarded that way throughout the school day and throughout every, or almost every, other area of her life, should be respected and treated like a girl,” the guidelines stipulate.
 
According to the Dept. of Education, transgender students are those whose assigned birth sex does not match their “internalized sense of their gender.”
 
They said gender nonconforming students “range in the ways in which they identify as male, female, some combination of both, or neither.”

“The responsibility for determining a student’s gender identity rests with the student,” the guidelines dictate. “One’s gender identity is an innate, largely inflexible characteristic of each individual’s personality that is generally established by age four…As a result, the person best situated to determine a student’s gender identity is that student himself or herself.”
 
The new rules would also prevent teachers and administrators from telling parents with which gender their child identifies.
 
“School personnel should speak with the student first before discussing a student’s gender nonconformity or transgender status with the student’s parent or guardian,” the directive states.
 
The guidelines were issued at the request of the state board of education to help schools follow the 2011 anti-discrimination law protecting transgender students.
 
“These students, because of widespread misunderstanding and lack of knowledge about their lives, are at a higher risk for peer ostracism, victimization, and bullying, the document read.
 
The Massachusetts Family Institute denounced the new rules calling them a violation of privacy.
 
“Fundamentally, boys need to be using the boys’ room and girls need to be using the girls’ rooms, and we base that on their anatomical sex, not some sort of internalized gender identity,” said Andrew Beckwith, the institute’s general counsel.
 
Beckwith told Fox News the new policy has a “very broad standard that is ripe for abuse.”
 
“The policy allows students to have one gender identity at home and another at school,” he said. “And it refuses to let teachers and administrators tell parents what gender their child is at school.”
 
Another part of the directive that troubles parents deals with students who might feel comfortable having someone of the opposite sex in their locker room or bathroom.


The state takes those students to task – noting their discomfort “is not a reason to deny access to the transgender student.”
 
And any student who refuses to refer to a transgendered student by the name or sex they identify with could face punishment.
 
For example – a fifth grade girl might feel uncomfortable using the restroom if there is an eighth grade transgendered boy in the next stall.
 
Under the state guidelines, the girl would have no recourse, Beckwith said.
 
“And if the girl continued to complain she could be subjected to discipline for not affirming that student’s gender identity choice,” he told Fox News
.

 
“It should not be tolerated and can be grounds for student discipline,” the directive states.
 
Gunner Scott, of the Massachusetts Transgender Political Coalition, praised the directive – and said punishing students who refuse to acknowledge a student’s gender identity is appropriate because it amounts to bullying.
 
“The reality is that it’s about creating an inclusive environment for all students to learn,” Scott said.
 
But many parents disagreed and said the directive actually gives transgendered students more rights and privileges than other students.
 
“It doesn’t treat all students the same,” said Bill Gillmeister, of Brookfield, Mass. “It has a greater preference to gender-identifying children. That concerns me a great deal
.”

 
Gillmeister told Fox News he has a son and daughter in high school. He also serves as a school committeeman.
 
He wondered about safety and fairness – especially when it comes to athletics. Under the new rules transgendered students will be allowed to play on either boys or girls teams.
 
“What about the girl who loses a spot on that basketball team because a boy is able to play as a girl,” Gillmeister wondered.
 
He worried about boys going into the girls locker rooms and vice versa.
 
“As a father of a daughter who might be playing sports, that concerns me greatly,” he said. “My daughter would likely not play a sport that she would otherwise play if she knew there was a potential for a boy to walk into the girl’s locker room
.”

 
Gillmeister predicted no matter what happens – there will be lawsuits.
 
“It will either be the girl who didn’t get a seat on the basketball team because some boy got it or some boy who wanted to use the girls’ room but was denied access,” he said.
 
Beckwith and others say the education department is using a loophole in the anti-discrimination law to create a “stealth bathroom bill.”
 
It’s affecting students as young as kindergarten,” he said.
 
The directive also calls on schools to implement gender neutral clothing rules.
 
“For example, some schools require students to wear gender-based garb for graduation or have gender-based dress codes for prom, special events and daily attire,” the directive states. “Schools should eliminate gendered policies and practices such as these.”
 
They pointed out on school that changed its dress code for the National Honor Society. The new policy does not require girls to wear dresses.
 
They also instructed schools to stop lining up students based on gender. Instead, they recommended lining up students using their birthdays or alphabetically.
 
Beckwith said it seems like Massachusetts is trying to create gender-neutral schools.
 
“They’re encouraging schools to eliminate all gender based distinctions,” he said.

The parents of a 6-year-old transgender girl who has been banned from using the girls’ bathroom at her Fountain, Colorado public school have filed a formal discrimination complaint with the aid of a lawyer—and are using the opportunity to speak out publicly in support of their child.

“The more you talk about something, the more awareness and acceptance there is,” Kathryn Mathis, mother of first grader Coy, who was born a boy.

Kathryn and her husband, Jeremy, appeared with Coy on the "Katie" show Wednesday to talk about the case. “The school is really missing out on something big,” Kathryn, a photographer and certified nurse’s assistant, said during the broadcast. “They could be taking the opportunity to teach all of the students that everybody is different and that we should embrace our differences and we should respect everybody. Instead they’re creating this divided environment where they’re showing all these children that a child is different and we’re going to treat them poorly because of it.”

Kathryn and Jeremy, a full-time student and disabled veteran, have four other children, including a set of triplets, one of which is Coy. Kathryn explained on "Katie" that Coy, a Girl Scout who loves pink, began gravitating toward girls’ toys and clothes by 18 months. Gender eventually turned into a bigger issue when Coy asked, at age 4, “When are we going to go to the doctor to get me fixed so I can be a girl?” A psychologist confirmed then that Coy was indeed transgender, at which point, noted Jeremy, “We really needed to let Coy be who she was.”

Yeah, all I can say is WOW...it's as if people today are doing all they can do bound-LESS their so-called "rights". Back in my youth days in the 80's/90's, even THIS was frowned upon(even though gay rights was being heavily promoted on my college campus).

Edit: Another alarming thing here is that this kid is only 6 years old. Isn't the age for these youths when they hit puberty and hormones kicking in is like 11 or 12? Again, this guy is ONLY 6 years old and is acting like this!

IMHO, the entertainment media and all the "goodies" they offer are playing a good part - I read this on Yahoo a couple of hours ago, now companies are doing all they can to market some of their toys to ALL genders(that for years and years were either marketed toward boys or girls ONLY). And they're being pretty subtle about it to boot.

Sometimes, there are verses in the bible that are hard to grasp for potentially years and years, and even when some things come to pass, you STILL have a hard time grasping them...

Yeah, I noticed that too.

Actually, I have a question about this. My husband and I couldn't reach a consensus. So here's the question:

Can a transgendered person get saved?

I thought yes, but then he brought up hybrids/Nephilum and how they can't be saved. But then I said how the boy is still a boy in God's eyes, just because he looks different doesn't mean his DNA was altered.

What do you think?

I thought yes, but then he brought up hybrids/Nephilum and how they can't be saved. But then I said how the boy is still a boy in God's eyes, just because he looks different doesn't mean his DNA was altered.

I posted these verses earlier in this thread, but will go ahead and post this again. A brethren from another message forum showed me these verses when we had discussions on another similiar issue(evil leaders like Hitler and Obama). And to be frank, I never understood these passages. And when these things have been coming to pass lately(like this story), even though these verses hit me, at the same time I STILL don't understand them...

Can they still get saved? With God, all things are possible. But at the same time, if there are any in your neighborhood et al, it may be wise to stay far away from them.

I don't think his parents forced him, per se, to do anything(at least from what I understand from the article) - but nonetheless they just don't seem to have any knowledge of morals and how to train up their children.

It's just that over time, especially over the last 60 years, we've had alot of wicked things infiltrating this country like rock music, eastern mysticism spirituality, taking God and prayer out of public schools, evolution, sexual revolution, abortions, MTV, MSG/greased fleshly laden fast-food restaurants, and not to mention too the modern-day church has slowly but surely have taken out the word of God from their pulpits and pews.

Ultimately, when you have in our present day young parents that have gone through these wicked institutions raising children, it's as if they are not armed in terms of knowing how to raise up their children. I read recently that a good % of family homes are either single parent or unmarried couples co-habitating(another thing wanted to add here).

This is kind of what I see with this family - and they're not the only ones, as this country has reaped what it has sown. No, don't get me wrong, not saying I nor other Christians are better than they are, but nonetheless when one generation of parents are not training their children properly(including feeding them with the word of God), it's only going to get worse for the next generation.

Edit: No, I'm not saying it's impossible now for the Millenials generation to get saved. For one, I myself is Gen X(which isn't much better, b/c it's close behind the Millenials), and two, we have a couple of Millenials on this message forum that are diligently doing a very good job being in the faith of Jesus Christ. But as a whole we are likely witnessing the last generation.

Most definitely yes they can be saved. ANYBODY who calls on the name of the Lord WILL be saved. THAT is a fact.

Calif. OKs bill allowing boys in girls' restrooms

A bill that would allow boys who say they identify as girls to use the girls' restrooms and locker rooms, and vice versa, passed the California Assembly Thursday (May 9) and now heads to the state Senate.

AB 1266, which passed largely on a party-line vote of 45-24, has been touted by supporters as "eliminating obstacles facing transgender people," but opponents have warned it "mandates San Francisco values on all California schools."

Under the bill, a student will be "permitted to participate in sex-segregated school programs, activities, and facilities, including athletic teams and competitions," consistent with "his or her gender identity, irrespective of the gender listed on the pupil's records."

California's action follows a "transgender rights" directive issued by the Massachusetts Department of Education in February accomplishing everything the California bill does.

"By imposing this radical policy on all schools in California, the legislature seeks to take away local control from the school districts, parents, and communities," Karen England, executive director of Capitol Resource Institute, a faith-based political action group in Sacramento, said in a statement.

"What this bill is saying is the rights of a few students supersede the rights of all other students. AB 1266 will bring many unintended consequences for students, school districts and communities," England said. "No student should be forced to share bathrooms or change clothes in front of members of the opposite sex. AB 1266 mandates San Francisco values on all California schools."

The bill's author, Assemblyman Tom Ammiano, D.-San Francisco, said it would force school districts to comply with laws prohibiting discrimination against transgender students.

"Will transgender students make some other children uncomfortable? Perhaps," Ammiano wrote in an op-ed for the Los Angeles Times last month. "I don't want to minimize that, but new experiences are often uncomfortable. That can't be an excuse for prejudice."

The National Center for Lesbian Rights, Equality California, Transgender Law Center and Gay Straight Alliance support the bill.

Republicans voiced opposition in the Assembly, according to The Sacramento Bee.

"I do not believe that allowing individuals of the opposite sex to use the same restrooms makes any sense at all, and I think the vast majority of Californians deeply oppose this," Assemblyman Tim Donnelly, R.-Twin Peaks, said.

The Bee reported that several school districts, including Los Angeles Unified and San Francisco Unified, already have policies letting students participate in activities and use facilities for the gender they choose.

Brad Dacus, president of Pacific Justice Institute, a traditional legal group, said "forcing boys and girls to share bathrooms, locker rooms and sleeping arrangements is not equality; it's insanity." PJI launched a website, genderinsanity.com, with information about this bill and a related one.

"Picture this ... your 7 year-old daughter comes home from school in tears," the website states. "You ask her what's wrong and she says she's afraid to go to the bathroom at school because a boy comes in while she's there. Outraged, you call the school to demand an explanation. You're told that your daughter is telling the truth, but because the boy says he wants to be a girl, their hands are tied. 'It's the law.'"

This part has been going on since the 1970's - Title IX - which was pushed by the feminist movement so that girls athletic programs would get equal funding with boys athletic programs. However, this has done more damage than anything else b/c the whole agenda was to drive the boys athletic programs to the ground.

Dr. Day talked about this further in "New Order Barbarians" - he said part of the eugenics/depopulation program of the NWO was to get the female youth to be sports role models, b/c in doing so they would focus on this, and not give bearing children second thoughts.

Colorado Civil Rights Division Rules Elementary School Must Allow Boy to Use Girls’ Restroom

The Colorado Civil Rights Division has ruled that a school district in the state discriminated against a six-year-old boy when it prohibited him from using the girls’ restroom.
 
As previously reported, the parents of Coy Mathis state that their son decided to stop living like a boy last year, as he complained about wearing jeans and t-shirts and gravitated more toward tutus and dresses.
 
“[Coy] wanted to know when we were going to take him to the doctor, so that they would give him girl parts, so that his body would be a girl,” Coy’s mother Katherine explained to reporters.
 
“[Coy told us,] ‘I’m a girl, but these people think I’m a boy, but really I’m not a boy,’” she said. “And we took her to the various doctors and they talked with her and came to the same conclusion: that for her emotional and mental well being she needed to be her true self.”

If someone told me 10-20 years ago, or even 5 years ago, that something like this would happen in my lifetime, I would have said "NO WAY!".

We are definitely living in the end times now.

Those parents should be charged with child abuse.

Since when does a 6 year old understand much of anything? They don't even know the concept of their rights, much less know how adults use children to forward a personal agenda.

Kids that age get their understanding from their parents first. They may not know what it means, but they adopt the parents stances in most cases, at least until they are mature enough to fully understand, and at which time they may well change their stance when they learn their parents were not teaching them correctly.

It's a hard pill to swallow, but our parents are people too, some believers, and some not. Some teach their children, some don't. But all kids pick up parts of who their parents are.

That boy needs to be taught the truth, instead of being lied to, and allowed to make decisions he's not mature enough to make.

If for some reason he doesn't like being a boy, tough! Take it up with God.

Christians Warn ‘Bathroom Bill’ Allowing Men in Womens’ Restrooms is Sweeping Nation

As Delaware recently became one of the latest states to enact what is known as the ‘bathroom bill,’ which permits males who identify as females to use the womens’ restroom and vice versa, Christians in the state are warning others across the country that similar legislation is sweeping the nation and may come to their state next.
 
Last month, the Delaware legislature passed the Gender Identity Nondiscrimination Act, which dealt with a plethora of protections for transsexual and crossdressing residents, including allowing those who identify with the opposite gender to be allowed to use the restroom of their choice. Following passage in the House 24-17 and 11-9 in the Senate, Governor Jack Markell signed the bill into law.
 
“Our mission to build a welcoming and accepting state that can compete in the global economy requires laws that reflect our values,” Markell declared. “Today, we guarantee that our transgender relatives and neighbors can work hard, participate in our communities and live their lives with dignity and in safety.”
 
However, during the public hearing for the legislation, a number of Christian organizations and pastors expressed their concerns about the measure. Nicole Theis, president of Delaware Family Policy Council, and Mike Fox, pastor of The Trek Church in Smyrna, were two of those who made their voice heard.
 
“This opens the door to so many questionable and very concerning things,” Theis told Christian News Network. “Women do not want to share [restrooms and locker rooms] with someone–with anyone–who is biologically a man, but thinks that they are a woman.”
 
“It goes against every single thing that we as Christians stand for,” Fox stated. “God said, in the beginning, He created them male and female. And so, from the very beginning to the very end of the Bible, this [bill] is demolishing every ounce of identity that God created.”
 
Theis advised that there is no exemption in the law for Christians or any entity that expresses disagreement. She explained that every public facility has to provide a “reasonable accommodation” under the new Delaware statute.

“If you don’t offer that, then you are in a position of being held liable,” Theis outlined. “You’re vulnerable if you are open to the public and you don’t offer that.”
 
Fox noted that churches and Christian businesses in the state may not realize that they are now mandated to allow men in womens’ bathrooms and vice versa if they identify with the opposite gender.
 
“If you’re a Christian business owner, it automatically immediately directly affects you,” he stated. “The biggest grieving of my heart is that churches have been apathetic. Christians have been apathetic thinking that it’s really not going to affect them in the churches, and that’s the farthest from the truth.”
 
Fox and Theis also warned that legal ramifications could ensue for noncompliance.
 
f you ever question [anyone] or deny them access into locker rooms, into bathrooms and public facilities, you are pretty much committing a hate crime,” Fox advised. “And so, if you stand up because you have morals and virtue and character, and you don’t want to condone and support any kind of transgenderism, then your business is going to be in trouble…”
 
“What we are seeing are lawsuits across the country where those reasonable accommodations have been made, but a lawsuit has followed anyway,” Theis explained. “[P]eople who struggle with this condition want to feel normal, and going to a restroom separate from everyone else or separate from the gender they identify with makes them still feel separate.”
 
While some may believe that the issue is isolated to Delaware, Theis warned that similar bills are being proposed in states across the country, and that legislation will soon be presented at the federal level.
 
“Already in Massachusetts, we see how there was a mandate in their school system to treat children according to how they identify, not their assigned sex at birth,” she stated. “So, we just see mass confusion coming from this effort to redefine social order.”
 
As previously reported, lawmakers in California recently passed legislation mandating that school students be allowed to use the restroom that suits their gender identity, and the Colorado Civil Rights Division ruled last month that a school district discriminated against a 6-year-old boy when it stopped him from using the girls’ restroom. Bills similar to the legislation now made law in Delaware have also been proposed in other states, such as New York and Arizona.

“I was just told that this transgender bathroom bill in a short time is now going to come to the table on the federal level, and it’s already hitting states left and right,” Fox said. “So, just like same-sex ‘marriage,’ … once it hits enough states, it’s going to be hitting the federal level, until the federal government says it’s discrimination for you to say anything or for you to make a transgender feel bad.”
 
He stated that what grieves his heart the most is the apathy of Christians across the country who naively believe that laws such as these won’t come to their state or won’t affect them.
 
“There’s very little public outcry,” Fox said. “It’s like the old joke: One person said, ‘Hey, did you hear about all the ignorance and apathy in the world?’ And the other said, ‘No, but I don’t really care.’”
 
“And it’s the same way with the churches — [it's a] life moves on kind of thing,” he continued. “Why aren’t there Christians marching–physically marching–outside of the legislative halls demanding that this be reversed?”
 
Theis agreed.
 
“We are at this point because we have abandoned this particular area of our culture, and we have left it to people who have a very opposite worldview, and set of values and agenda,” she said.
 
She exhorted Christians across the country to take action now before similar bills become law in their state.
 
“What we urge people to do in other states is to understand that this is a part of an overall agenda that is being pushed on state legislatures,” Theis said, “and unless Christians are involved, or people who just believe in maintaining such important social order as to what is male and what is female, [it will become law in their state].”

“I would really encourage people to engage the legislature with excellence and ask questions, and understand where they are in the decision-making process, so that they can help them work through the issue and come to the right conclusion,” she continued. “[We need to help them] understand why this is so problematic, and to have the boldness and courage to vote against such a massive, lucrative, very well-funded agenda that we’re seeing in state legislatures across the country.”
 
Fox said that it is the duty of every Christian to be salt and light in the culture, and the “bathroom bill” is no exception.
 
“I would encourage every Christian … to stop looking inside of the church, because the battle is not on the inside of the church,” he stated. “The battle is on the outside. [We must] gather together as Christians and speak up and speak out.”
 
“Jesus said, ‘If you’re ashamed of Me in front of men, I’ll be ashamed of you,’” Fox added. “And so, it’s easy to talk to other Christians about morality and Christianity, but Paul said, ‘Show me your faith without your works, and I’ll show you my faith by my works, for faith without works is dead.’”

I have this feeling around me too, and it's felt like this for the last couple of years. Sometime down the road, the ole' phrase "We're sorry we missed the train" is going to come to pass.

California lawmakers approved a bill Wednesday that would require public K-12 schools to let transgender students choose which restrooms they use and which school teams they join based on their gender identity instead of their chromosomes. Some school districts around the country have implemented similar policies, but the bill's author says AB1266 would mark the first time a state has mandated such treatment by statute. Existing state law already prohibits California schools from discriminating against students based on their gender identity, but the legislation that passed the state Senate on Wednesday spells that out in more detail, said Carlos Alcala, a spokesman for the bill's author, Democratic Assemblyman Tom Ammiano of San Francisco.

The U.S. Justice and Education departments said Wednesday that a transgender California student who is anatomically female but lives life as a male must be able to use school bathrooms, locker rooms and other facilities designed for boys.

The first-of-its-kind decision from the agencies tasks the Arcadia school district outside Los Angeles to change district policies and practices to accommodate the rising ninth-grade student. Teachers and staff must be trained in how to prevent gender discrimination, and federal agencies will be keeping tabs on the district through at least 2016.

The Arcadia school district also agreed to keep the student’s birth name and any records that indicate his natural sex confidential.

The student, whose identity has also been kept out of documents associated with his case, would have the right to request a private locker room and other facilities for the sake of privacy or safety. He must also be allowed to participate in any school activities on and off campus that are intended for boys.

The Education and Justice departments have forced districts to change policies and practices to better protect students who are transgender, including in Minnesota and elsewhere in California. But those protections, primarily intended to prevent bullying and harassment, have been part of agreements to protect all students who are lesbian, gay, bisexual, or transgender.

Wednesday’s resolution is the latest in a series of actions by the Obama administration sending a message to schools about the treatment of LGBT students. The White House has hosted bullying summits on the issue. The Education Department’s Office for Civil Rights has sent districts a letter reminding them of their responsibilities to protect students against discrimination based on gender, race, religion, and sexual orientation. And the Education Department has affirmed the right of students to form gay-straight clubs that have the same privileges as other clubs and school groups.

The 10,000-student school district did not immediately return a phone message.

While the agreement is only between the district and federal agencies, it sets a precedent, said Asaf Orr, a staff attorney at the National Center for Lesbian Rights, which filed the complaint on behalf of the Arcadia student.

“This sends a clear message to school districts around the country saying ‘This is what the federal government is going to be expecting of you,’” Orr said.

How schools should treat transgender students has been in the spotlight in recent months. In June, a civil rights agency in Colorado found that the Fountain-Fort Carson School District must treat 6-year-old Coy Mathis, born a boy but who identifies as a girl, as a female. Some states, including Massachusetts, already have guidelines for how to best accommodate transgender students.

The Arcadia student, born female, identified as a boy from a young age, the federal complaint says. At about 5 years old, he told his parents that he prayed to God asking to be put in the male body that he was supposed to have. He began transitioning from female to male as a fifth grader.

The student and his family filed their complaint after a series of issues with the district.

Orr said while the district was quick to address any bullying or harassment of the student by peers, the student was stigmatized . At school, the student was required to use the school nurse’s bathroom instead of school lavatories and locker rooms, Wednesday’s letter to the district says. Sometimes, he found the door locked and had to search for a school employee to open the door. And getting to and from the bathroom required a trip across campus, prompting questions from classmates about what was taking him so long. At times, the student avoided using the bathroom at school all day.

And on a trip the student took as a seventh grader that the district billed as a big step for students — an overnight trip without their parents — he was required to sleep in a cabin away from other students and had to be chaperoned by his father.

“I know that he and his family feel at ease now, going into high school with all this in place,” Orr said. “He can focus on being a kid and learning.”

Legislation Extending Federal Protection for Cross-Dressers Heads to Full Senate

The full Senate will consider a bill sponsored by Sen. Jeff Merkley (D-Ore.) that would add “actual or perceived sexual orientation” and “gender identity” to the list of federally protected traits, which currently include race, religion, age, gender and disability.

The Family Research Council describes The Employment Non-Discrimination Act (S. 815) as “giving special rights and protections to people based solely on their sexual behavior,” warning that ENDA “is to the office what the repeal of Don’t Ask, Don’t Tell was to the military.” (S.815.pdf)
 
ENDA cleared the Health, Education, Labor and Pensions Committee July 10th on a 15-7 vote, with Republicans Mark Kirk (Ill.), Orrin Hatch (Utah), and Lisa Murkowski (Alaska) voting with the committee’s Democratic majority.
 
“The term “perceived gender identity” means if a confused man claims he feels like a woman, he must be allowed access to the ladies bathroom (at all public restaurants, shopping malls, and your office at work), or employers will be sued for “segregation,” explained former Navy chaplain Gordon Klingenschmitt of The Pray in Jesus Name Project.
 
“They don’t actually need a sex-change operation to sue you, they just need to claim someday they may desire a sex-change, and YOU must protect your male employee’s right to dress like a woman, and have full access to the women’s bathroom, or be sued. The religious exemptions in this bill do not protect for-profit Christian business owners, such as Bible publishers, Christian retail stores, or public restaurants.”
 
In a statement after the vote, the White House praised HELP Committee members for sending ENDA to the full Senate for the first time since it was introduced back in 1994.
 
“[The President]  thanks Committee Chairman [Tom] Harkin, Senator Merkley, and Senator Kirk for their leadership on this important issue.  The President has long supported an inclusive ENDA, which would enshrine into law strong, lasting and comprehensive protections against employment discrimination on the basis of sexual orientation or gender identity. “
 
The bill imposes penalties under Title VII of the Civil Rights Act of 1964 and the Employee Rights Act of 1991 on private employers who discriminate against individuals on the basis of their “gender identity,” which the legislation describes as “the gender-related identity, appearance or mannerisms or other gender-related characteristics of an individual, with or without regard to the individual’s designated sex at birth.”
 
Under the bill, state and local officials, including those who work for local school districts, are not immune, and can also be sued in federal court for employment discrimination.
 
“Unlike past bills, Sen. Merkley's version doesn't include an exemption for bathrooms, which means that employers at daycares, public schools, and Christian businesses would all have to change their restroom and shower policies to accommodate men who dress like women and vice-versa.,” FRC president Tony Perkins noted.

Feds force school district to allow transgender girl to use boys’ bathrooms, locker rooms

It’s all the rage these days for transgender students (or their parents) to sue or make a big fuss because their genitalia doesn’t match the bathrooms and locker rooms they prefer to use.

The latest flare-up occurred in a quiet, expensive suburb northeast of Los Angeles. The Arcadia Unified School District in Arcadia, Calif. finalized an agreement with the U.S. Department of Education to terminate a Title IX investigation into allegations of discrimination against a transgender middle schooler, reports the Los Angeles Times.

The agreement resolves a complaint pressed by the Department of Education and filed on behalf of an unnamed student who was born female but wants to be a male.

The complaint alleges that school officials prevented the female student from using the boys’ bathrooms and locker rooms in sixth and seventh grades just because she doesn’t have a ****. The complaint also alleges that school officials didn’t allow the student to stay in a cabin with boys during a district-sponsored overnight camp. Instead the student was allegedly required to stay in a cabin separate from both male and female students.

The Arcadia school board unanimously approved the agreement this week, promising to take immediate steps to ensure that the transgender student will now be treated like other male students. In addition, the district promised to treat gender-based discrimination as a form of sex discrimination henceforth.

“I am glad that my school district has agreed to put in place the protections that I, and other transgender students, need to feel safe and welcome in school,” said the student in a press release circulated by the National Center for Lesbian Rights. “Knowing that I have the school district’s support, I can focus on learning and being a typical high school student, like my friends.”

An eight-page agreement letter from the Department of Education’s Office for Civil Rights summarizes many additional details of the original complaint. The student has “identified as a boy from a very young age” and “began consistently to assert” the hairstyle, clothing choices and manners typically favored by males in elementary school. The student adopted a masculine first name, started identifying with masculine pronouns and used a gender-neutral bathroom.

It was apparently in the sixth and seventh grades when the student wanted to use the boys’ bathrooms and locker rooms, and was denied. The cabin incident occurred in seventh grade.

The student is headed to ninth grade in the fall. Federal bureaucrats will be keeping a watchful eye on the district until at least 2016, notes Politico.

There has been a raft of recent stories with this same basic storyline across the country.

For example, in June, the Colorado Civil Rights Division decided that is is illegal discrimination to prohibit a transgender first-grader from using the girls’ bathroom at a public elementary school. The Transgender Legal Defense and Education Fund filed a complaint that led to the ruling on behalf of the first-grader’s family. The student, Coy Mathis, was born biologically male but wears girls’ clothes all the time and had also been using the girls’ bathroom at Eagleside Elementary in Fountain, Colorado near Colorado Springs.

“Compartmentalizing a child as a boy or a girl solely based on their visible anatomy,” the ruling asserted, “is a simplistic approach to a difficult and complex issue.”

Earlier this month, a transgender student in Florida complained to local media that a trade school wouldn’t allow him to use the women’s restroom. The student, Alex Wilson, was born male and is four years into a hormone therapy process designed to transform him into a female. He hasn’t undergone gender reassignment surgery. The school stepped in after an unidentified student protested Wilson’s use of the ladies room. Wilson was offered the use of a private bathroom. However, he deemed it unacceptable because, he explained, it is located in an inconvenient storage area.

Meanwhile, the state of Massachusetts is something of a transgender hotbed.

An 11-page set of guidelines recently distributed by The Bay State’s Department of Education mandates that transgender students are to be permitted to use the bathroom they feel most comfortable using. The rules apply to every public high school, middle school and elementary school in the state. (RELATED: New Massachusetts rules allow transgender students to choose their own bathroom)

Just in time for that ruling, a student at Middleborough High School has become the first transgender prom queen in the entire history of Middleborough, Mass. (pop. 23,000 or so), the cranberry capital of the world. (RELATED: Mass. high school crowns its very first transgender prom queen)

Strangely, though, a transgender high school student who applied to prestigious, private, all-female and typically very progressive Smith College was rejected because the school only accepts women. (RELATED: Transgender student denied admission to all-female Smith College)

Smith returned Calliope Wong’s application — and application fee — earlier this month.

“As you may remember from our previous correspondence, Smith is a women’s college, which means that undergraduate applicants to Smith must be female at the time of admission,” admissions dean Debra Shaver wrote in a letter to Wong.

Wong has identified as female for several years. However, on the FAFSA (Free Application for Federal Student Aid) Wong seems to have checked the gender box saying male.

Smith’s rejection places reliance on the laws of Connecticut, Wong’s home state. The state categorizes Wong as male and would only recognize Wong as a female after expensive, complex sex reassignment surgery.

“Yes, I was born into a body with typically male parts,” Wong blogged last fall. “But I identify and am living as female. Prevailing scientific and medical opinions support the fact that who I am identity-wise is different from the gender identity typically associated my physical body.”
