North Carolina Governor Signs Pro-Life Bill Stopping Abortions

Late Thursday night, the North Carolina state Senate passed a pro-life omnibus bill that would stop abortions by helping pregnant women and stopping taxpayer financed abortions.
 
Today, Governor Pat McCrory has signed the bill into law.
 
The State Senate concurred by a vote of 32-13 with the State House, on SB 353, Health and Safety Law Changes. The State House worked with the Governor and his Department of Health and Human Services to reach an agreement for a compromise bill that accomplished pro-life goals in a way the governor would sign into law.
 
SB 353 addresses concerns about the administration of abortion inducing drugs and rules for abortion facilities, North Carolina Right to Life informs LifeNews. The pro-life provisions that were left intact after the compromise are: the opt out for abortion in the federal exchange and the city and county employee health plans, as well as the sex selection and web cam abortion bans.
 
“Thousands of unborn children’s lives will be protected from abortion,” stated Barbara Holt, President of North Carolina Right to Life, “by preventing the expansion of tax payer funded abortion through the federal exchange. By passing this legislation, our state has also demonstrated that it will not tolerate unborn babies being aborted just because they are the wrong sex or doctors being miles away from the patient when they administer drugs that kill the unborn baby and can harm the child’s mother.”
 
Governor Pat McCrory stated in a press conference prior to the State House passing SB 353 that he would sign the bill when it comes to his desk.
 
“North Carolina and the citizens of this state are pleased that Governor McCrory has said he will sign the bill into law; we look forward to the new law protecting unborn babies and their mothers,” said Holt.
 
The measure would prohibit sex selection abortions which 76% of North Carolinians support (Civitas March 2013 poll) and 85% of Americans support (Polling Company April 2013 poll). Some six states have already banned sex-selection abortions.
 
The bill includes an opt-out of abortion in the federal exchange and the city and county employee health plan except for the life of the mother and in cases of **** and incest. An April 2011 CNN poll found 61% oppose public funding for abortion, consistent with other poll done by other groups and 22 other states have stopped abortion funding under the Obamacare exchange.
 
The measure would require abortionists to be physically present to prevent web cam abortions and the misuse of abortion inducing drugs.
 
North Carolina joins Virginia, South Carolina, and Tennessee, as well as 19 other states, by opting out of abortion in the federal exchange; 14 states , by banning “web cam” abortions; and 6 states, by prohibiting sex selection abortions.
 
An abortion clinic in the state was shut down this month for posing problems for women’s health. Last month, North Carolina officials allowed a southeast Charlotte abortion clinic to reopen, but vow they will closely monitor operations at A Preferred Woman’s Health Center. The abortion clinic was shut down in early May, the second time the clinic has lost its license.
 
The first occasion was in February 2007, when, as the Charlotte Observer reported, “state investigators found as many as 16 safety and regulatory issues at the clinic, according to a letter DHHS sent the clinic.”
 
More recently, investigators found that staffers were administering methotrexate (an abortifacient) in liquid form. The regimen requires that methotrexate be injected or taken in pill form.

So a "compromise" bill is GOOD? How? Jesus says either you're with me or against me, there's no compromises or 2 ways.

As for bills that would stop taypayer financed abortions - remember George W. Bush quietly stuffed provisions in bills that funded millions to Planned Parenthood.

And there lies the hypocrisy - they supported Mitt Romney last year, whose Romneycare provided taxpayer abortions in MA. Who are these people trying to fool?

Reuters) - A federal judge on Friday struck down a 2011 North Carolina law requiring abortion providers to perform an ultrasound and explain it to a woman before having an abortion, arguing it violated the constitutional right to free speech of doctors.

U.S. District Judge Catherine Eagles found that a state does not have "the power to compel a health care provider to speak, in his or her own voice, the state's ideological message in favor of carrying a pregnancy to term."

The law "compels a health care provider to act as the state's courier and to disseminate the state's message discouraging abortion, in the provider's own voice, in the middle of a medical procedure, and under circumstances where it would seem the message is the provider's and not the state's," she added in her 42-page ruling.

"This is not allowed under the First Amendment," Eagles ruled.

The U.S. Supreme Court legalized abortion nationwide in 1973, but lawmakers in more conservative states in recent years have enacted laws that seek to place restrictions on the procedure, especially on late-term abortions.

The ultrasound requirement of the law had been blocked by Eagles a few months after it was passed due to concerns over what she described as the "non-medical message" doctors were required to deliver.

The law required that an ultrasound image be presented and the sound of the fetal heartbeat be offered at least four hours before an abortion, though a woman is free to look away and ignore an explanation and medical description of what is on the screen.

The decision was hailed as a victory for the American Civil Liberties Union, the Center for Reproductive Rights and Planned Parenthood Federation of America which filed a lawsuit challenging the Women's Right to Know Act.

"Today's ruling protects the rights of women and their doctors from the ideological agenda of extremist lawmakers," said Jennifer Rudinger, executive director of the ACLU of North Carolina.

"This law represented an egregious government intrusion into individuals' private medical decisions, and we are very pleased that it will not go into effect," she said.

Defenders of the law said it provided crucial information for women making a major and irrevocable decision.

"North Carolina's ultrasound requirement is no different than requiring speech for airlines and cigarette manufacturers for safety reasons," said Barbara Holt, president of North Carolina Right to Life. "The required information must be given even if the person hearing, seeing or reading the information finds the information upsetting, unnecessary or repetitive."

A Republican state legislator who advocated the law, House Majority Leader Paul Stam, was not immediately available to comment after normal business hours.

North Carolina Governor Beverly Perdue, a Democrat and the state's first female governor, vetoed the measure in 2011 but the state Senate overrode the veto.

In her veto message, Perdue called the legislation a "dangerous intrusion into the confidential relationship that exists between women and their doctors."

When the law went into effect in October 2011, North Carolina joined 25 other states that require pre-abortion counseling that goes beyond basic medical "informed consent," according to the Guttmacher Institute, a nonprofit sexual health research organization.

It also became the tenth state to include the additional requirement of an ultrasound, which has drawn legal challenges in several states.

North Carolina has some of the country's toughest requirements for clinics performing abortions, including a requirement doctors be present when abortions are performed.

It also bans publicly funded health insurance programs from paying for most abortions, and authorizes state health officials to design rules for increased safety standards for abortion clinics.

In North Carolina, 17 percent of pregnancies end in induced abortions, according to the Guttmacher Institute.

The case is Gretchen S. Stuart, M.D. et al v. Ralph C. Loomis, M.D. et al: 1:11-CV-804.

The problem I have with this whole argument is that it's based on opinion, not medical reasons. If it were in fact about medical reasons, as it should be, then the "patient" is entitled to full disclosure of all medical issues relating to their "condition". By not medically informing the patient of the situation, the patient is at a disadvantage by the doctor withholding information that the patient may well have wanted to know, but laws and people with wicked opinions are getting in the way of sound medical practice, and the socialistic federal courts are backing it all the way, trampling on state's rights.

This statement right here is about as unnerving as it gets, seeing it's from a judge sitting on a bench...

I'm having a real hard time believing that a sitting judge would say such things as an official ruling.

The "state's message" doesn't discourage abortion by requiring an ultrasound, nor is the state advocating any ideological position! That's absurd at best.

This isn't about ideology, but the wicked baby-killers want to make it that way so they can confuse the discussion and hide the real issue, which is the patient's right to an informed medical decision, and the doctor's vow to "Do no harm" under the "Hippocratic Oath" for medical professionals.

If as a medical practitioner, you have a diagnostic tool that provides a more clear information about the patient, it's non-invasive and does no harm, then why in the world would they withhold that information? We know why. These evil people don't want women to know the truth, period. They are lying to them for the sake of the love of money, literally at the expense of a human life.

The absolute insane wickedness of these people and their doctrines make me so angry, but I know God WILL deal with these people in due time. God WILL punish the unrepentant wicked men, and women, of the world.

All I can say is, "Look out Planned Parenthood and the like, judgement is coming!
